Calgary Branch Luncheon | How to Avoid Claims and Limit Risk in Engineering
Claims are unresolved disputes over scope and schedule that can include litigation or arbitration, usually relating to construction disruptions or delays. The issue for engineers is that they can be dragged into claims even if they’re not the direct cause. This is especially the case for design-build, engineering, procurement, and construction management-type companies and practitioners where engineering can often have direct and indirect effects on construction progress.
Risks involved relate to either direct liability for delay or disruption, or being dragged into litigation as one of the stakeholders. Either way, avoidance and mitigation rests on proper understanding of your contract and contractual relationships, and the administration of your work process, all bundled with clear and timely communication.
This presentation will elaborate common issues and mitigation strategies, which will be illustrated with case studies.

As project, construction and contacts management consultant, I apply years of experience in engineering, planning and project controls to analyze the challenging circumstances encountered by clients, and to explain results of that analysis in a clear, professional, and concise manner that can be understood by a non-technical audience. I have eight years of forensic project analysis experience, backed by over 22 years in the engineering, procurement and construction industry. I have qualified and appeared as an expert witness at Court of Kings Bench in Alberta, and at arbitration.
I have a long history of mechanical engineering and project management work in the Calgary oil and gas industry. I also have experience with commercial and light industrial projects, and investigative work, both through Anderson IRC and the APEGA Investigative Committee.
